Terms of Service

Welcome to DuDu Rides. These Terms of Service (“Terms”) govern your access to and use of the DuDu Rides mobile application (Android package: com.rides.Dudutech), our website at https://dudurides.com, and related services (collectively, the “Service”) operated by DuDu Rides (“we”, “us”, or “our”).

By creating an account, logging in, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

DuDu Rides is a mobility platform that currently offers or facilitates:

• Ride-hailing — passengers can request electric scooter / EV rides, see fare estimates, track drivers, pay for trips, rate drivers, and message drivers during active rides
• Driver services — approved drivers can go online, receive ride requests, navigate to pickup and drop-off locations, complete trips, and manage commission-related records
• DuDu Rent — passengers can browse electric scooters for rent, submit rental applications, upload required documents, and pay via supported methods
• Offers and shop links — promotional products and links to our online shop
• Additional services — other features marked “coming soon” may be added in future updates

We are a technology platform. Unless explicitly stated otherwise, we are not a transportation carrier, employer of drivers, or vehicle owner. Drivers and rental partners may be independent third parties.

2. Eligibility

To use the Service you must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Have the legal capacity to enter a binding agreement
• Provide accurate registration information
• Comply with all applicable laws, including traffic and vehicle regulations in Nepal

Drivers must additionally pass our Know Your Customer (KYC) review, provide valid identity and vehicle documentation, and maintain any licenses or permits required by law.

3. Accounts and authentication

3.1 Phone verification

Accounts are created and accessed using phone number and OTP (one-time password) verification. You agree to provide a valid phone number that you control and to keep it up to date.

3.2 Account security

You are responsible for:

• Maintaining the confidentiality of OTP codes and device access
• All activity that occurs under your account
• Notifying us promptly at support@dudurides.com if you suspect unauthorized access

We may suspend or terminate accounts that appear fraudulent, abusive, or in violation of these Terms.

3.3 Passenger and driver modes

The same person may switch between passenger and driver modes where permitted. Driver access requires separate approval after KYC verification.

4. Ride-hailing terms

4.1 Booking rides

When you request a ride:

• You must provide accurate pickup and destination information
• Fares shown are estimates until a ride is confirmed; final charges may vary based on route, wait time, cancellations, or other factors displayed in the app
• You agree to be present at the pickup location when the driver arrives
• Service availability depends on driver supply and is primarily supported in areas such as the Kathmandu Valley

4.2 During a ride

• Passengers and drivers must behave respectfully and follow applicable traffic laws
• In-ride chat is provided for trip coordination only; harassment, threats, or illegal content are prohibited
• Drivers share live location with passengers during active trips as part of the Service

4.3 Cancellations

• Passengers or drivers may cancel rides according to in-app options and applicable cancellation rules
• Repeated cancellations, no-shows, or misuse may result in fees, account restrictions, or termination

4.4 Payments for rides

• Supported payment methods may include cash and other methods shown in the app at the time of booking or completion
• For cash rides, passengers agree to pay the confirmed fare to the driver
• Digital payment flows, where available, are processed through our backend and/or third-party payment providers
• You are responsible for verifying the fare and payment status shown in the app before leaving the vehicle

4.5 Ratings

After trips, passengers may rate drivers. Ratings must be honest and not abusive. We may use ratings for quality control and safety decisions.

5. Driver terms

If you register as a driver, you additionally agree that:

5.1 Independent operator

You operate as an independent contractor, not as our employee, agent, or partner, unless a separate written agreement states otherwise. You are solely responsible for taxes, insurance, vehicle maintenance, fuel/charging, and compliance with local laws.

5.2 KYC and documentation

You must submit truthful information and clear photos including, as applicable:

• Personal photo and government ID
• Driver’s license (where required for your vehicle type)
• Vehicle ownership or authorization documents
• Vehicle photos and registration details (plate number, model, color, year)

Providing false or misleading information may result in permanent removal from the platform.

5.3 Vehicle and conduct standards

You agree to:

• Use a roadworthy vehicle appropriate for the service type (including EV scooters / cycles where applicable)
• Hold valid licenses and permits required by law
• Not drive under the influence of alcohol or drugs
• Not discriminate against passengers
• Accept and complete rides in good faith when online

5.4 Online status and location

When you go online or are on an active ride, the app collects and transmits your location to match you with passengers and provide live tracking. You may go offline at any time when not on an active trip.

5.5 Commission

Drivers may owe platform commission or fees as shown in the app. Commission summaries, ledgers, and payment instructions are provided in the driver portal. Failure to pay outstanding commission may result in suspension.

6. DuDu Rent terms

6.1 Rental applications

When you apply to rent a scooter through DuDu Rent, you agree to provide accurate personal details (name, phone, email, address, rental dates, emergency contact) and upload required documents such as citizenship and license copies where requested.

6.2 Approval and pickup

• Rental requests are subject to approval; submission does not guarantee availability
• Security deposits, pickup procedures, and vehicle condition checks may apply as communicated during booking
• You must return vehicles on time and in the condition received, ordinary wear excepted

6.3 Rental payments

Rentals may be paid via methods shown in the app, including Khalti, eSewa, or cash, where supported. Third-party payment providers have their own terms. You are responsible for completing payment and retaining any confirmation references.

6.4 Use of rented vehicles

You agree to:

• Use rented vehicles lawfully and only for permitted purposes
• Not sublease or lend the vehicle without authorization
• Report accidents, theft, or damage immediately to us and to authorities as required by law
• Bear financial responsibility for damage, loss, or fines caused during your rental period except as otherwise agreed in writing

7. Offers and third-party links

The app may display product offers or link to dudumart.shop or other external sites. Those purchases are governed by the respective seller’s terms. We are not responsible for third-party products, delivery, or warranties unless explicitly stated.

Features labeled “Coming soon” are not yet available and may change before release.

8. Acceptable use

You agree not to:

• Use the Service for unlawful purposes
• Impersonate another person or provide false identity information
• Harass, threaten, or endanger other users
• Interfere with the Service, scrape data, or reverse engineer the app except as allowed by law
• Use the Service to transport illegal goods or weapons
• Manipulate ratings, fares, referrals, or payment systems
• Upload malware, offensive content, or documents you do not have the right to share

We may investigate violations and cooperate with law enforcement where required.

9. Intellectual property

The DuDu Rides name, logo, app design, software, and content are owned by us or our licensors. You receive a limited, non-exclusive, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• Continuous, uninterrupted, or error-free operation
• Availability of drivers or rental vehicles at all times
• Accuracy of maps, routes, ETAs, or geocoding
• That any driver or renter will meet your expectations

Maps and routing are provided for assistance only. You and your driver remain responsible for safe navigation and compliance with traffic laws.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill
• Our total liability for any claim arising from the Service shall not exceed the greater of (a) the fees you paid to us for the specific trip or rental giving rise to the claim in the three (3) months before the event, or (b) NPR 5,000 (or equivalent in local currency)

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless DuDu Rides, its operators, affiliates, and personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Content or documents you submit
• Accidents, injuries, or property damage involving your use of a vehicle as a driver or renter

13. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you violated these Terms, pose a safety risk, or if required by law.

You may stop using the Service at any time by logging out and uninstalling the app. Sections that by nature should survive termination (payments owed, disclaimers, liability limits, indemnity, dispute resolution) will continue to apply.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to that processing.

15. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be posted at https://dudurides.com/terms-of-service with an updated date. Continued use after changes constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved informally by contacting support@dudurides.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Kathmandu, Nepal, unless mandatory consumer protection law in your jurisdiction requires otherwise.
